Supreme Court refuses potentially landmark gun-control case

The US Supreme Court on Monday turned down the appeal of a Maryland man who said the state’s restrictive gun-permit law violated his constitutional right to carry a firearm in public for self defense.

The case, Williams v. Maryland, was being closely followed because it might have set the stage for another potential landmark Second Amendment decision by the high court.

The justices did not explain why they rejected the appeal, but the action does not end the possibility of a gun-rights case reaching the court this term. The Supreme Court is awaiting briefs in at least one other gun case, and several other Second Amendment cases are working their way to the Supreme Court.

          i agree , they are the ones who are in contempt,they promised to uphold the constitution, that we have the right to bear arms, then they support laws that invalidate that. that is treasonous. the laws are so complex and restrictive they in effect take away our rights. how can you travel across state legally. the permits do not work, you need dozens of expensive permits and tests to travel with a weapon concealed. if it is unconcealed you will be thrown in jail ,even though the laws allow it . its time to kick some ass.. if we dont they will slowly one by one attack those patriots who have weapons. until the public is disarmed. that is obamas goal. then he can rule without regard for law.

            I would lik to reply to the needing a dozen permits. I live in California, our Permit Law, states that every Sheriff, is the issueing agency for the State, we have 53 Counties, maybe half of them are what I call PRO GUN, they will issue permits the other half will not issue except to the big money in their county, the one that contribute to their campaines. The permit is good throught out California. My point if your Sheriff issues permits, unless restrictred it is good for the intire State. If you can find some one close to you that is Certified for Flordia, and Utah, you will have about 36 States.             We are guaranteed this right in the Constitution, our second amendment! I see no reson to even have to have a permit. A background check should be enough to get you a gun. Permits are just a way to suck dollars out of your purse or wallet. Call your representatives and introduce a bill to fight this tyranical law or what ever the powers to be want to call it.

            The U.S. Constitution and its Amendments were created for the purpose of protecting American citizens from their own government’s potential tyranny.

            The United States Constitution is the supreme law of the land. It establishes the form of the United States government, and the rights and liberties of the American people. It is the shield of democracy under which Americans govern themselves as a free people.

            Even though the ‘Second Amendment’ is in part, the law of the land; why are States of the Union in violation by legislating confusing gun-control laws which are in direct conflict with the U.S. Constitution and its 2nd Amendment? In fact; States are clearly over-stepping their boundaries of the 10th Amendment. State governments are forbidden to act only in cases where the power to act has been placed in the federal government.

            A great deal of federal, states, and local legislative confusing gun control laws are generally created by career representatives who have nothing better to do. In this case, rather than reduce a term in Office, we should amend Article I; Section 2.; 17th Amendment; and the 20th Amendment to read; “immediate RECALL to remove and elect a new official, including any member of the United States Supreme Court Justices who fail to honor the Oath of Office and the U.S. Constitution.

            Allow me to quote what is stated in Article VI; (2) “This Constitution, and the laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every State shall be bound thereby, anything in the constitution or laws of any State to the contrary notwithstanding.” This simply means that when state laws conflict with national laws enacted within the powers granted to Congress, the national laws shall prevail.

            If the above be true; then what the hell are states creating laws that are in direct conflict with federal laws?

            Shawn: Don’t forget, according to constituitonal law, the Constitution may not be overturned by a mere Act of the legislature. I believe that means that no State, County, or City entity has the authority to deprive anyone of their right to keep and/or bear arms as clearly stated in the Constitution.

            The issue starts when the first word of
            a new gun law is written.
            My copy of the II Amendment states, “A well regulated Militia, being necessary to the security of a free state, the right of the people to keep and bear Arms, shall not be infringed.” Are we a part of the “Militia” if we are ex service men? We are subject to recall! So to the amendment as it is written, we the people have a right to recall elected officials if theymake such laws. We the people should NOT allow them, elected officials, to enact such laws.

            Its a shame that so many patriots could be so ignorant to the meaning of “militia”. The Militia was everyone. We did not have a standing army in fact the founders were fearful of standing armies. WE HAD JUST WON A WAR WITH CITIZENS SOLDIERS OR MILITIAS. They were private forces which most people belonged to and trained with. They are what fought the Revolutionary war(there was no country we were rebelling against the established British government) and what 1st filled the ranks of the southern army of the War Between The States or if you will the War Of Northern Aggression( hint: it could not be a “civil” war since the south never tried to take over the US government). Point is, Militias have always been private or non- government and the founders recognized their necessitiy to maintain a free state to resist tyranny!

            The woeds “to keep and bear arms” means just that. The word “bear” means to wear or have on ones person. If you are so damned afraid someone who is carrying a legal weapon is going to “suddenly feel frightened”, then maybe you should stay home and eat delivered take out. People who carry conealed weapons, the vast majority that is, are law abiding citizens who take our 2nd amendment seriously believing it means exactly what our founders meant.
            Also, while we are on the subject, I never leave home without a weapon. In case you have not read the papers or listened to the news lately, there are a lot of bad people in this world. Some are psycho’s, some are just mad at the world, others are sociopaths, etc, etc, etc.
            Personally, I carry because I realize what a nasty world we live in. I want to die in bed in a peaceful manner, not on some sidewalk or alley because some scumbag wanted what little money I may have on my person.

            I shall give you the benefit of doubt about having seen the video of a young woman testifying before the legislature about having seen her parents and others killed in a McDonalds restaurant by a “madman” who drove his truck into the restaurant and just started killing people.

            In her testimony she recounted reaching into her purse for her gun and then remembering that it was in accordance with the law in her car out of her access range. She explained that she did not blame the killer. “After all, you don’t blame a mad dog.” She blamed the legislature for disarming her when she could have prevented half or more of the killings. In her testimony she said, “Could my gun have misfired, yes. Could I have missed, yes, but I can assure you that I have hit much smaller targets at a much greater range.”

            @Jesussaid Love – You just go ahead and wait for the police to show up and save you. While you are waiting you might as well call the funeral home and make the necessary arrangements.

            Where I live, it would take the “local” sheriff’s department at least 15 minutes to get to my house. In that amount of time a criminal could smash through my door, assault and or kill my wife and me, take whatever they want to steal and flee into the woods never to be seen again, much less prosecuted.

            Fortunately, here in Texas, I have the right to defend myself with lethal force including the use of firearms (of which I have several) anywhere on my property. I am also able to carry my firearms with me in my vehicle and have the right to use lethal force whenever and wherever a criminal decides he wants to press his luck. If someone breaks into my house, or even shows up at my house and I believe they intend to harm me or my wife, I legally can and legally will fill them with a pound or two of lead.

            The only thing I need the LEO’s to do is come out to the house and bring the coroner with them so they can haul off the body or bodies. I will never give up my weapons regardless of what international treaties or other laws that are ever written. GOD gave me the right to defend myself and my loved ones. The 2nd Amendment merely agrees that I have that right.

Conservatives don’t think like liberals, we assume judges will make fair constitutional decisions, but these judges are being appointed because they will vote certain ways and are constantly being pressured for specific outcomes.

          The purpose of having supreme court judges rule for life-terms is so that the judiciaries can be left to do their business with no threat of losing their jobs. If they could be easily thrown out of government, they would could have their decisions swayed a certain way, and no longer be impartial and independent.

You see , this is the first president who will put in at least 3 judges in . They are put in for their views of they’re party that they vote on . For that , the judges should have no ties to any party , in order to be imperial and independent when sitting on that chair . They aren’t . Look at the last one that Comrade Obama put in this court . She already made it clear that she doesn’t like the military .

          The court is suppose to only interpret the law, not write it. The constitution says we have the right to bear arms. If they interpret or do away with that part of the constitution, it means they can and will do away with any part of the constitution including freedom of religion and/or speech. This will be interesting. I know there are thousands of arms’ caches around the US and I doubt any of them will be giving up any arms soon. The day before the election the gun shops in San Antonio, TX were very busy. Liberals as well as conservatives were purchasing guns. Liberals and blacks were worried what would happen if Obama got in.
          Those that neglect learning from History will see History repeated and even be victimized by it. Right now we have the elitest in Washington, Hollywood, people like Soros, Gore, Turner, etc, who want to destroy the middleclass and make us a classed society like the feudal system. They seem to forget when there is more of us than them, they probably won’t live to spend their fortunes, if they are actually worth anything in the end. Besides most of them are sitting in Switzerland or some other foreign investment with not ready access. I say there is more value in a basement of food and necessary goods than Soros’ gold.

Back in 1933 the Fed Gov’t did away with the Gold Standard this country went bankrupt at that time but this country was never told. The Fed Gov’t became a corporation. Now back to the Constitution. If you would go back and read the original document it does not say the Constituton of The United States of America, this was changed in 1933 to reflect the corporation of the USA. The original document says “Constitution for the United States of America” that is different to reflect to incorporation of the USA. Why do you think there is a “district of Columbia”?             Many spelling errors are a matter of speed typing and not paying close attention to what was just typed. Others are lack of spelling skills. In any event does one persons vote, or their worth, or their rights as an American change because of his or her spelling skills?

We have a welfare system totally out of control – we have illegal aliens taking jobs away from American’s and our government won’t even attempt to close our borders – instead Obama sues Arizona. People who believe in the Constitution had better wake up – it is going to take all of us to bring this country back to what it once was. Donald Trump even said “we are now a poor country”. And if we don’t act immediately we will be another third world country – i.e. Greece?

          The idea of lifetime appointment for judges is to put them apart from politics, campaigning, owing their job to their next vote etc. Note the scandal just a few years ago about the Texas Supreme Court elections which were ridiculously corrupt as validation of the original isolation theory. In the early days The Supreme Court was so seldom needed they did not have their own building in D.C.. They were not involved in every major issue as they are now, being asked to referee for the other two branches. The Courts, at all levels could help themselves immensely by declining cases that review legislation or that seek to make legislation by sending the parties back to their elected legislatures.

            As a retired Texas lawyer, I suspect that you must be from here in Texas. Both parties in turn have given us some justices to our state Supreme Court and state Court of Criminal Appeals, which are separate here, who have been or are so clearly morally, professionally, and otherwise unfit when first one and then the other controlled things that one appreciates even the imperfect appointive system in the federal courts and some states. One had arrest warrants outstanding, another lied and claimed he had never run for office before when, in fact, he had run for Congress in his former state and lost. He got re-elected after being reprimanded by the State Bar for that. The average primary much less general election voter doesn’t know these people from Adam’s off ox and it’s too dangerous for knowledgeable lawyers to call one out.

            The nice thing about the cases where the Supreme Court is construing Acts of Congress rather than the Constitution is that, at least for future cases, Congress can correct the result, and do what it should have done in the first place and write the laws more clearly to avoid such issues. Sometimes Congress plays political games and intentionally leaves an issue raised in a statute unresolved, bucking that part of their work to the Court, with the result that nobody knows the law until after the Supreme Court speaks.
            When the Supreme Court gets the Constitution wrong, there is no remedy short of a Constitutional amendment, which is extremely difficult, expensive, and usually practically impossible, until and unless the Court can be persuaded to take another case and correct its own error. They blew it in Plessy v. Ferguson, as Justice Harlan the Elder from Kentucky tried to tell them in his prescient dissent, and it took 86 years before the Court finally realized that separate was not and never would be equal and corrected itself in Brown v. Board. In Kennedy v. Louisiana, the four liberal Justices plus the swing vote handed down an opinion striking down the laws of several states and Congress explicitly based upon their own subjective “feelings.” Liberal former Constitutional Law professor and President Barack Obama, and liberal leading Harvard professor of Con Law, Supreme Court advocate, and Obama mentor and adviser have said they disagreed with the result in that case on federalism issues, but there probably is no way to get that particular issue back before the Court in the future.

      Term limits don’t work. Many states and municipalities have term limits. None have accomplished what term limit proponents hoped they would. Term limits are a populist placebo. It does not foster new people in office, it only create a sort of musical offices game in which the same people swap offices to restart the term limit clock.

      The notion isn’t even logical. No one enhances their freedom or improves their options by limiting their own choices.

      Term Limits on the Supreme Court are a horrible idea. Among other things, this would increase the frequency of changing the makeup of the court and would eliminate the continuance of good judges.

      What we need is a congress that will exercise its obligation to oversee the federal courts and remove any judges who are not acting in “good behaviour” (this is the spelling in the Constitution and defines the term limit of federal judges under the Constitition.) as Constitutionally required as the requirement to hold their seats, but have violated their oath and are now acting in “bad behavior”.

      This is also a very good reason to replace any senator who voted to confirm one or more of these “bad behavior” judges.

      Congressional Reform Act of 2011

      1. No Tenure / No Pension.
      A Congressman collects a salary while in office and receives no pay when they are out of office.

      2. Congress (past, present & future) participates in Social Security.
      All funds in the Congressional retirement fund move to the Social Security system immediately. All future funds flow into the Social Security system, and Congress participates with the American people. It may not be used for any other purpose.

      3. Congress can purchase their own retirement plan, just as all Americans do.

      4. Congress will no longer vote themselves a pay raise. Congressional pay will rise by the lower of CPI or 3%.

      5. Congress loses their current health care system and participates in the same health care system as the American people.

      6. Congress must equally abide by all laws they impose on the American people.

      7. All contracts with past and present Congressmen are void effective 1/1/12.
      The American people did not make this contract with Congressmen. Congressmen made all these contracts for themselves. Serving in Congress is an honor, not a career. The Founding Fathers envisioned citizen legislators, so ours should serve their term(s), then go home and back to work.

      If each person contacts a minimum of twenty people then it will only take three days for most people (in the U.S. ) to receive the message. Maybe it is time.

      Term limits are wrongheaded. Judicial posts should not be political. We do not need judges pandering to the same empty headed voters that liberals routinely influence. A mandatory retirement age may, I repeat, may be appropriate, but I’d have to carefully consider the ramifications of a specific proposal before I would promote that idea.

      Judges may be impeached. That is the way to remove them. Your real argument is with the politicians and prosecutors, but then I repeat myself, that refuse to initiate such action out of misplaced loyalty to their friends, cronies and golf partners who are complicit in their crimes and derelictions.

      I agree the Supremes also need term limits. I think a Supreme can be recalled, however I am not a Constitutional lawyer (or even a lawyer) so I don’t know if that is possible. I do know the last two appointed by the Usurper should not be in the court. My question: If an investigation into the constitutional eligibility of Hussein and he is found ineligibile, I know that everything he has done, bills signed etc., become null and void – does that also apply to the Supremes?

    Actually the constitution gives us Americans more power than we realize. I especially adore the second amendment, it means when things get really bad we don’t need to vote. That’s my interpetation of that amendment and why it is crucial we keep that right. It isn’t meant to protect my house but it covers that, it doesn’t mean I can go and hunt, it is specfically addressing tyranny.

      You are correct. It is good to see a person who has read what the founders wrote. The Second Amendment was included to prevent oppressive and tyrannical government.
      The revolution had made us free of the King, and most of the founders insisted that the “people” had the ability to keep the government from becoming oppressive. Some states have in their constitution what fire arm each citizen must have and how much powder and shot. The constitution would not have been ratified with out the Second Amendment. The founders intent was that a citizens army (militia) could be formed to repel any attempt at turning the country into a kingdom or dictatorship.

      Your weapons permit is the second amendment any state that has the requirement to have a “permit” to be armed is in violation of the constitution.

        But the Second Amendment does specify “a WELL-REGULATED militia”. That means permits. It does NOT, however, mean “bans”. A permit would suggest a certain amount of training to make sure you know how to handle the damn thing in a responsible fashion and it would suggest a background check to make sure you’re not apt to go down to the corner of Second and Main and gun down 20 or 30 people. Just as you don’t have to get a new driver’s license every time you drive a car so you shouldn’t have to go through a new background check or take a new training course every time you get a new gun. Once in a lifetime and a five minute check ought to be enough.

Areas of the country where gun ownership is common are also areas where fathers are very strict with their sons about how they handle a gun and if a police officer takes a kid’s BB gun away from him the boy’s dad blames the kid. It is not unreasonable that someone demonstrate they know how to load a gun and how to carry it properly.

      Oh they go even further than guns! A few years ago I wanted to start selling non-lethal self-defense products like pepper sprays, stun guns, ect. Found out much of that is ILLEGAL or restricted in a lot of the Big Blue states and Lib Cities. You can sell only the milder pepper sprays in Michigan. A lot of places won’t let you sell little fit-in-a-purse-or-pocket canisters of tear gas (if you spray it into the wind it will blow back in your face) A lot of places ban stunguns that look like cell phones or ladies rings that shoot pepper spray because these things are “deceptive” and not fair to use against a criminal–concealed weapons. A stun gun is powered by a little 9-volt battery. It works by overriding the nervous system and commanding all the muscles to contract thus sapping an attackers available strength for a few minutes. But if this poor innocent criminal has been using drugs his heart might not be able to survive and so it could send him into a heart attack and he dies–making him the poor innocent victim who was only going to rape and strangle you. So these non-lethal self-defense products are illegal or greatly restricted in a lot of places.

        Another thing that most people are not aware of is the states that have not restricted gun rights and have concealed carry laws like Oregon , Wyoming, Colorado and such have way lower crime rates and are usually run by a Republican and Independent majority’s then the States that have outlawed guns and everything else, like Washington DC which has the highest crime rate in the nation followed by Chicago and Detroit run by Democrats. it is true in all blue states, they have higher crime rates than the red states

    Over all of the years of my observation it appears that The Court WANTS to keep the mystery/argument regarding the Second Amendment right to “keep and bear arms” just that; mysterious, argumentative, and unresolved.

    I can’t see how that status quo serves any useful purpose for either side of the issue.

    I also have contended that the “militia” versus “keep and bear arms” issue shouldn’t exist as an issue as the two points are seperated by a comma, and thus both are seperate, independent rights and neither are mutually and exclusively dependent upon the other.

    The main reason, historically, to stiffer regulation of firearms is merely to subjegate the people to the will of government. Thomas Jefferson stated that the government should be totally cleaned out every 20 years to prevent the type of dishonorable manipulation of We the People. Jefferson further stated that after said action the We the People, should elect a new government based on the Constitution, unwavering.         Start with the president and the congress. The president proposes and the congress approves. Wthout congress’s approval the president cannot appoint anyone to the S.C. The biggest problem is congress, most of them are lawyers. Vote the dam lawyers out of congress. We don’t need a legal interpretation of the constitution, it’s plain and simple language that anyone can comprehend. Lawyers should not be allowed to legislate from the bench, if it’s not in the constitution, it’s not legal. Get back to the basics, they worked for two hundred years.

    EVERY dictator first of all disarmed the citizens. The British did it in India and then subjugated them to slave status (even Ghandi said the most damaging thing the Brits did was to take away their guns), Hitler did it in Germany, Castro in Cuba and the list goes on and on. Under the constitution it is the people who are in charge; not these bozo’s in Washington. The fact that the courts and government are out of control taking away our rights should be a wake up call and warning sign. If the President has term limits so should every other government leader. It is just not the 3 main branches but all of the other petty bureaucrats who stay for decades given power to write regulations (like our goofy HHS Director) which diminish our rights and freedoms. I hope it never gets to the point of another civil war and I will fight hard against it heading that direction with my voice and my votes.

    Our children have NO education in the true history and rights/responsibilities of citizenship. Many adults I speak to have NO CLUE except what they think they will gain in their pockets. We had better educate ourselves and our children.

    It is OUR nation; let us DEMAND explanations and accountability from OUR Legislative/Executive/Judicial branches. They are to be held accountable to the American people.

Make it an 8 yr term, then thats it. Next ,cut congressional pay to $85,000 per year, no free gyms,no 100 person staff. Thats $50,000 more than the average American makes a year. Let them see what its like to survive on the rules they pass. Each Congressperson has to sit for 2 weeks in DC each month,and the other 2 weeks in his home town office,where “the people” can come and see him. No more $30K a plate dinners so only the rich have access. Same with the Senators. This country will never change unless we stop these career politicos who have served 45-55 years some of them. Theyve never had a job! They dont know whats going on in the street.       As a precinct delegate, I will add a comment here from what has been locally experienced. The Judges are listed as non-partisant and usually on the bottom or back of the ballot. People have no real knowledge of who is running for the judicial positions. TV and radio ads are about all that is in front of them and to really get to know if a judge is liberal or conservative, it takes a lot of research and attending conventions and getting to know them before the elections. Often people do not know what the judges stand for and also they omit voting for them so a vote is almost useless with the general population. We had judges come to our Tea Party meetings and saw them in different places before the election and had a chance at least to have some idea who we were voting for. In our case, conservative judges were voted in but with a small amount of people even voting for them as most left the voting booth once the party line candidates were selected.

    It is amazing to me that people aren’t allowed by law to carry in MD without unreasonable rules concerning conceal carry. There are parts of MD that I would never go to if I couldn’t carry a gun. Ironically, they are in the parts of the state that control most of the politics of the state. Namely The City of Baltimore, Prince Georges County, and Montgomery County. These are the areas where there are a lot of robberies and murders of unarmed honest citizens.

    The Supreme Court acts just like the news media. First it accuses anyone who does not give it what it wants, saying certain officials are trying to suppress information to keep it from going to the public. Remember, the public has a right to know. But, the media does not show all the information it has to the public and withholds whatever it sees fit. So, it is the one that does the censoring.
    This decision is the same, the supreme court has decided that instead of coming to grips with a problem, they will censor it, just like the media.
    The supreme court is in place, to interpret the laws, i.e., define words, etc. As if the definition in the dictionary, that we have been using for hundreds of years is not clear enough.
    The sad part about it is that when they refuse to rule, in a case like this one, they do not need an excuse or explanation. Thus their “higher than thou” attitude. They are appointed for life so they don’t even worry about loosing their jobs.
    As said before, they are there to define our Constitution, as if it needs such. Just as the media does whenever a high official has a press conference and gives a speech. The media feels we are so uneducated that we don’t know what the person said, so the media has to have a recap, telling us what the person said. Again they and the supreme court feel they have, actually seen it necessary to tell us what a simple word means, as though we cannot read nor comprehend.
    IMHO, local judges have a better sense of what is right and what is wrong than the supreme court and they normally don’t take months or years to make a decision.
    That’s just my take on the supreme court. A few people appointed to the highest court of the land, to judge, using the idiologies of differing cowards we elect as president. I you have not been in the united states military, first you should not be President of These United States. Second if you haven’t served in the United States military or have been at least in law enforcement, you damn sure don’t belong on the U S Supreme Court.
    They are just lazy people earning big dollars, paid with the money of the poor, and they have the nerve to want the money of big business and people who have worked hard all their lives. Go figure.

    I have long been an advocate of a Constitutional Amendment to have all judges (Federal, State & Local) elected by the people, do away with life time appointments by corrupt politicians and limit their terms in office! They can’t be expected to honor our Constitution if they are not held accountable by “We the people! ”

    Lifetime appointments was one of the few mistakes our “Founding Fathers” made! It’s time to correct it!

    If you cannot have a gun then that makes you more apt to be controlled by a power. I believe that is the whole of their agenda…to make us weak/defenseless. Hard for a dictator to rise if those he means to rule can fight back. They can take our guns, but what they don’t realize is that there will be another, greater “shot heard around the world” if they try to do so.
    I am all for term limits, but who can we find to elect into office that would be willing to fight for term limits. Our government has been sucking off the teat of the constituency for so long, that it will be very hard to rip them away from said teat. Where will be find an individual, male or female, with enough honor and integrity to push for term limits. They have it made once they are elected in right? Perks like no one else will ever see by their own making. Kind of a groovy job that you can go into and give yourself pay raises, vacations, personal healthcare, etc..
    I do not own a gun yet, but let them try and take my bow away from me…..

If Obama gets re-elected with no worries about being elected again, the maelstrom of presidential directives, circumventing the congress and personally deciding what laws to enforce or not to enforce will make your head swim. The fear of the voting public has kept him in check the last year or so.. otherwise imagine if he simply had gained steam from that first year. No thank you.     Maryland again! In 1988 I was crucified by MD for defending myself (the police were
    called but did not come) against a drunken drugged assailant who had broken INTO MY
    HOME!! Assaulted 3 times while my wife was on the phone begging for help I finally had
    to shoot or be killed/maimed by the huge crazed brute. He lived! The states attorney had
    intended to charge me with 1st degree murder if he died. Aint that sweet?
    Then later on when he started following me to work at 5AM, I tried to get a permit. They
    wouldnt even give me the forms to fill out; let alone review and either pass or fail me!

    Now does this ruling also mean I cant take my guns from my home to my car and transport
    them to the gun club range to shoot targets??

    There is a mistaken belief that the “Constitution” grants the people some rights such as the Second Amendment. This is NOT correct. We the People did NOT surrender any of our Rights to the government we created. The founders only delegated some of our powers to the central government for the convenience of all the people. The Srpreme Court has ruled that the first ten amendments are areas where the government does not have power to legislate. When our representatives start to legislate in one of these areas, why not file a suit against him/her for “breach of contract” at 5 USC 3331 to 3334? If they violate their oath boot them out now. If we do not involve ourselves in government at the local level, we are not in control, the government is. The government has been left to its own devices too long, and we must step up and take back what they have usurped. Keep an eye on events out in Oregon and Northern California and most likly coming to a community near you……

This leads to corruption and political views that are in great contrast the the will of the poeple.     the actual laws itself. They are subject to try to make laws inviation of their of office. This is

    Any judge that can bring affects to all of the people in their Constitutional Rights should be held accountable to the people. Their term should never be longer then four years without a vote judging their performance as to wheather voted back in

    A true free man should be able to walk the earth, (provided not on private property) and be able to defend himself and his family or in the “stead” of someone unable to defend themselves such as children, women, elderly and such.

Today’s gun control laws, some 22,000 of them, are onerous and every one of them flaunts the Second Amendment. ALL men should be permitted to own guns, or not own guns, HIS choice, NOT the government’s. If a man wants to protect himself or his family, by what God-given right does government stand there and tell you, no, you can’t do that. Interestingly, the most venomous anti-gun politicians themselves have concealed carry permits. Diane Feinstein does, and so does Barbara Boxer. The President, of course, has a cadre of armed guards to protect him. Only the ordinary little guy citizen can’t protect himself. We need to change that! ANYONE who wants a gun for self protection – or for ANY purpose, including sport hunting, target practice, safety while traveling, whatever – should be able to do so without question. And yes, I include criminals in that category, since they already have guns anyway, and they are citizens, too.

    We are a Christian Nation and Christianity teaches forgiveness. We are supposed to have a statue of limitations. 7 years. The government shouldn’t be letting anyone out of prison if they are deemed too dangerous (capitol offenses) but if a convict paid his debt than it is paid. He is still a man and still needs to protect his family. If someone commits a horrific crime then hang em or whatever. But, everyone else is still a man and needs to be able to defend themselves.

    The only thing I can say about all of this is that the U.S. Constitution, as written by the founders of this republic, guarantees the rights of the actual citizens of these United States to own and carry guns. There is no limitations in the U.S. Constitution on the number or types of guns we can own or on the ammunition. As such, I and many many more like me will continue to defy any and all anti-gun grabs or regulations that are dreamed up by idiots and fascists like the Bradys, Hillary or obama. If free, law abiding actual citizens of this republic must become criminals to uphold and enjoy the freedoms and liberty afforded us under the U.S. Constitution, even if the powers that be finally get their way and completely undermine or destroy this document, then we will likely become criminals in the extreme and there will be NO limits to the designs or the capacity of the weapons we create to replace everything that the gun grabbing criminal thugs take away from us. Personally, I am working on some ideas for some very creative non-firearm devices that I believe will be cheap to create, easy to use and a lot of fun at target practice or hunting.     Hello all, I am just a 48 year old male that has lost everything due to the regime that is in DC. job, home, family, car, truck and my dog even got run over, but if people would just try for one minute understand that it only takes common knowledge to know that if you spend more money than what you have coming in, you will soon go broke. If I remember correctly, there was someone in a high office that wanted a bridge built that would link a town of 185 to a place where there was no road at to begin with. No after $125 billion dollars later, the town is now 148 and there is still at this time, no road on the other side of the bridge. This was bridge was finished in 2003 and still today, it is not used for anything other than a bird perch. When the idiot that made this happen had applied for the money, he should have been shamed and not given a medel. If the us, the tax payers are just going to sit by and watch all the money burn in a barrel, then we can’t complain. If your not part of the solution, then your part of the problem. I have went from a 6 figure income to now being on food stamps and hand outs and I hope that my life will be spared when I finish college and to have time to find a job to pay back the school loans. I’ll bet it will be like hitler done in Germany, they killed all the people that had a debt so that they could start clean. It’s not Washington DC that’s the problem, they did not get there on their own. We put them there and its up to us to get them out. May God have mercey on our soul!

    Politicians are the only people in the world who create problems and then campaign against them..
    Have you ever wondered, if both the Democrats and the Republicans are against deficits, WHY do we have deficits?
    Have you ever wondered, if all the politicians are against inflation and high taxes,
    WHY do we have inflation and high taxes?
    You and I don’t propose a federal budget. The president does.
    You and I don’t have the Constitutional authority to vote on appropriations. The House of Representatives does.
    You and I don’t write the tax code, Congress does.
    You and I don’t set fiscal policy, Congress does.
    You and I don’t control monetary policy, the Federal Reserve Bank does.
    One hundred senators, 435 congressmen, one president, and nine Supreme Court justices equates to 545 human beings out of the 300 million are directly, legally, morally, and individually responsible for the domestic problems that plague this country.
    I excluded the members of the Federal Reserve Board because that problem was created by the Congress. In 1913, Congress delegated its Constitutional duty to provide a sound currency to a federally chartered, but private, central bank.
    I excluded all the special interests and lobbyists for a sound reason. They have no legal authority They have no ability to coerce a senator, a congressman, or a president to do one cotton-picking thing. I don’t care if they offer a politician $1 million dollars in cash. The politician has the power to accept or reject it. No matter what the lobbyist promises, it is the legislator’s responsibility to determine how he votes.
    Those 545 human beings spend most of their energy garnering votes to stay in power and convincing you that what they did is not their fault. They cooperate in this common con regardless of party.
    What separates a politician from a normal human being is an excessive amount of gall. No normal human being would have the gall or insolence of a Speaker, who stood up and criticized the President for creating deficits…. . The president can only propose a budget. He cannot force the Congress to accept it.
    The Constitution, which is the supreme law of the land, gives sole responsibility to the House of Representatives for originating and approving appropriations and taxes. Who is the speaker of the House? Nancy Pelosi. She is the leader of the majority party. She and fellow House members, not the president, can approve any budget they want. If the president vetoes it, they can pass it over his veto if they agree to.
    It seems inconceivable to me that a nation of 300 million can not replace 545 people who stand convicted — by present facts — of incompetence and irresponsibility. I can’t think of a single domestic problem that is not traceable directly to those 545 people. When you fully grasp the plain truth that 545 people exercise the power of the federal government, then it must follow that what exists is what they want to exist.
    If the tax code is unfair, it’s because they want it unfair.
    If the budget is in the red, it’s because they want it in the red.
    If the Army & Marines are in IRAQ and Afghanistan , it’s because they want them in there.

    If they do not receive social security but are on an elite retirement plan not available to the people, it’s because they want it that way.
    There are no insoluble government problems.
    Do not let these 545 people shift the blame to bureaucrats, whom they hire and whose jobs they can abolish; to lobbyists, whose gifts and advice they can reject; to regulators, to whom they give the power to regulate and from whom they can take this power.

    Above all, do not let them con you into the belief that there exists disembodied mystical forces like “the economy,” “inflation,” or “politics” that prevent them from doing what they take an oath to do.
    Those 545 people, and they alone, are responsible.
    They, and they alone, have the power..
    They, and they alone, should be held accountable by the people who are their bosses.
    Provided the voters have the gumption to manage their own employees…
    We should vote all of them out of office and clean up their mess!

    Heller v. DC has guaranteed firearm ownership, what is being discussed however is the right to carry. California has abolished the right of open carry in most all circumstances except a handful. Most posters seem to be arguing the second amendments wording on various sides, but the definitions of the time the amendment was enacted is what truly defines the amendment itself, and the 3 key words are Militia, Keep, and Bear arms.

    Militia; a military force that is raised from the civil population to supplement a regular army in an emergency.
    ■ a rebel force acting in opposition to a regular army.
    ■ (in the US) all able-bodied civilians eligible by law for military service.
    – origin C16: from L., lit. ‘military service’.

    Keep; 1 have or retain possession of.
    ■ retain or reserve for use in the future.
    ■ put or store in a regular place.
    ■ (of a perishable commodity) remain in good condition.

    Bear; 1 carry or convey.
    ■ have as an attribute or visible mark.

    Arms;1 weapons; armaments.
    2 distinctive emblems originally borne on shields in battle and now forming heraldic insignia.

    Based on the above, it only makes sense that while a Militia is a body of of age citizens, and to bear is to visibly carry, it has to be noted that Keep and Arms are the two words most people confuse.

    The definitions come from WordReference.com, however my unabridged Merriam-Websters Unabridged Dictionary circa 1946 has as a lower definition for Keep as innermost secure portion of a castle. That said, to Keep is to maintain possession of and storing securely for future use.

    Lastly, Arms are not only the weapons, but the crest or herald on a shield or insignia designating some type of authority.

    It is most important to note the order of which this amendment is written, as it provides a formula as to the proper use thereof. First, A well regulated Militia refers to more than one individual at a time, how can one person secure a free state? Have we all been deluded by Rambo? The right of the people… people, not person, to Keep (secure for future use) and Bear ( carry) arms (weapons and insignia).

    Everyone has the right to free expression, and that is how these forums exist, but so many people are so passionate about what is a common thought, or beer house fantasy, that they jump on a ban wagon not much unlike what happened during the late unpleasantness of WW2.

    The words of our Constitutions were carefully chosen so as interpretation was to be very little, yet crafty enough to keep up with the ever-changing world.

    For those whom desire to have their way, my words will be ill-regarded, I’m sure. But it is what the 2nd Amendment actually says, so for those of you who want to argue, argue with your own belief not whether or not the definition is wrong.

    WE all know what the 2nd amendment is and what it is intended to do. Give us a way to protect ourselves from any harm and mostly from the gov’t. When they finally take the guns or try to………….you will be severely at their mercy…….just like it was in Germany…………………………
    People need to read their history books.
    I will keep and bear arms.

    We the people must have a strong foundation and be united in order to defend our rights to own and bear arms. If one has a strong force and backed nationally that is supported by the people,such a force would make Washington pay attention. EVERY GUN OWNER THROUGHOUT THE UNITED STATES SHOULD BE A MEMBER OF THE NATIONAL RIFLE ASSOCIATION. The membership fee of $35.00 is nothing in respect to your rights To own and bear arms. Lets not kid ourselfs, money and mass unity with proper representation is what Obama and Whitehouse are afraid of. (Imagine the power to protect your rights would be if we had this type of organization with membership by everyone who owns a gun.) Every NRA member should ask others to join nationally !!!!!!!!!!!!! ( If you notice Obama and others trying to run for president,never discuss the right to bear arms as they know this would destroy their chances to be re-elected or elected) THIS IS YOUR COUNTRY AND EVERYONE HAS THE RIGHT TO PROTECT THEMSELFS.

    There was somebody near the front up there,– that went under the Identification of “Jesus loves” or something like that! I would have responded, but of course I would have been rejected for “writing too fast”, so here I am about 400 responses later! Did you know that there are lots of things mentioned in the Bible besides love?? True,– there is something in there in the “10 big suggestions” that says “thou shalt not kill”! But none of those says “under no circumstances”,– nor does it say “thou shalt kneel over the chopping block,- as somebody (with malice or covetousness for thine riches),- choppeth thine head off”!! There is a time and a place for everything! (Yep! That is in there too!).. In modern english,- that means murder or steal or kill.. Just in case he needs help figuring this out! I would think that actually would mean you have a right to defend yourself too! Anybody disagree so far??

    Now let me explain real life! Yes I did “serve!” I crawled in the mud, got holledred at, and shot at, and called all kinds of worthless “defication” at one time! During that time I recieved weapons training,— not that I needed it, I was farmiliar with all that stuff, (except being cursed so much)… Because I was raised in the country – (and in the woods)! I know for instance that most bullets travel in excess of 1,400 feet per second! … I have seen very few police cars that can go over 200 mph,– in town probably less than 50mph! Now the police are generally somewhere between 3 minutes and 8 minutes away… Now assuming you can get a message to the police! Rememer you are not supposed to use cell phones in many places now, and they are supposed to be turned off!! — So you may be violating the law using one of these too?? So lets take the “best senerio”, and say the police are there in 3 minutes! Now how many bullets do you think can have passed through your body at 1,400 feet per second (most are much faster)! .. Ok now the police arrive,- guess what! They are carying their guns to protect themselves (first)! Your personal safety usulally becomes secondary to their own! Now lets consider that this “gunamn” is a really bad guy!! He starts a “shotout” with the police!! Now there are lots of bullets coming your way (they do not have names engraved on them for “who to kill”)! Sometimes victums get shot, and even sometimes killed! How is that idea for you?

    Now owning a gun,- and having it handy,- does not do the job (by itself), – unless you know how to use it!! However having one helps noe the less! Some thugs are scared of guns too (in others hands)… And if you use yours early enough after criminal blows thorugh the door like a “rat on steroids”, – if you unload on him right then,- he may become too “heavy” to contnue further!! Now if it should happen to be in your house, – he does not belong there, and you can shoot first, – even if he doesn’t! A prybar, ball bat, knife, or closed fists, etc. is a weapon, – and you have a right to defend yourself….. In my case I am 72 years old, not much of a fighter anymore, – but “Mr. Colt” can stand by and solve the problem — if need be!! I am not old enough that I do not want to die by beating, stabbing, or gunshot wound! Still “too young to die”– want to die of old age instead!

    That Italian Cruise Ship that sunk last month!! — The equipment was there, but the people had not been trained to use it! They depended on the “authoritys” to protect them,-then when finlly told to “abandon ship”, not only did they not know what to do,- the boats were only useable on one side (they waited too long) , the ones that did get used did not go down easily – or properly,– lucky so many survived! Now the Captain (was saving himself!).. He was the main authority here… He really made things come out “in favor of the people on board”………. NOT!!

    I for one have never been more disappointed in the high court and Chief Justice Roberts, then I am at this point with him being in charge . I thought when he got in the court would go by the Constitution in every case. It has not. This court has been as bad as the Obama, Administration.
